Acceptable Use Policy

1. About this Policy

This Acceptable Use Policy ("Policy") forms part of the Agreement between Apilex Teknoloji Anonim Şirketi, operating as Apilex ("Apilex", "we"), and the Customer, as incorporated by reference in Section 4.3 of the General Terms and Conditions ("GTC"). Capitalized terms not defined in this Policy have the meaning given to them in the GTC. This Policy applies to Customer and every User accessing the Services under Customer's account.

2. General Prohibited Uses

Customer shall not, and shall ensure that its Users do not, use the Services to:

• (a) violate any applicable law or regulation, or infringe any third party's intellectual property, privacy, or other legal rights;
• (b) provide licensed or regulated professional services, including legal advice, legal representation, or the filing of legal documents, on the basis of Output without the meaningful review of a qualified individual, or in a manner inconsistent with Section 3.2 of the GTC and the professional conduct rules applicable to Customer;
• (c) make or materially inform any decision producing legal effects on, or similarly significantly affecting, an individual, without meaningful human oversight by a qualified individual;
• (d) exploit, harm, or attempt to exploit or harm minors or other vulnerable individuals in any way;
• (e) generate, upload, or process biometric data for the purpose of identifying or categorizing a natural person, except as expressly permitted by the Documentation;
• (f) transmit any virus, malware, or other harmful code, or otherwise interfere with or compromise the integrity, security, or normal operation of the Services or any system or network connected to them;
• (g) use the Services, or any Output, to develop, train, or improve a product or service that competes with the Services;
• (h) circumvent any usage limit, rate limit, access control, or authentication mechanism of the Services;
• (i) misrepresent Customer's or a User's identity or affiliation, or impersonate any person or entity; or
• (j) upload or process any content that Customer or its Users do not have the necessary rights or consents to provide, including personal data uploaded in breach of the representations and warranties given under the DPA.

3. EU-Specific Restrictions

Where Customer is established in, or the Services are used within, the European Economic Area, Customer shall additionally ensure that the Services are not used, directly or indirectly, in a manner prohibited under Regulation (EU) 2024/1689 (the "EU AI Act"), including to:

• (a) carry out social scoring of natural persons;
• (b) carry out biometric categorization of natural persons to infer or deduce race, political opinions, trade union membership, religious or philosophical beliefs, sex life, or sexual orientation;
• (c) create or expand facial recognition databases through untargeted scraping of facial images;
• (d) carry out real-time remote biometric identification of natural persons in publicly accessible spaces for the purposes of law enforcement; or
• (e) evaluate or classify natural persons based on their social behavior or personal characteristics in a manner leading to detrimental or unfavorable treatment in contexts unrelated to those in which the relevant data was originally generated.

This Section 3 is in addition to, and does not limit, Section 2 above or Section 14 of the GTC.

4. Enforcement

Apilex may investigate any suspected violation of this Policy and, without prejudice to any other right or remedy available to it, may suspend or terminate Customer's or a User's access to the Services in accordance with Section 4.5 of the GTC.

5. Updates to this Policy

Apilex may update this Policy from time to time. Material changes will be notified in accordance with Section 1.4 of the GTC.
